Seeking Alternative Pathways to DACA

Deferred Action for Early Childhood arrivals, also known as the DACA provides deferral of removal and two years of employment authorization for individuals that meet all requirements including physical presence, education, and arrival in the US prior to age 16, among others. The program has faced many legal challenges since it was originally enacted through executive action in 2012.

The United States Citizenship and Immigration Services (USCIS) is currently only processing renewals of DACA and related employment authorization for current recipients due to a court order.

Potential Options Available to DACA Recipients

Depending on an individual’s immigration background and qualifications, there may be alternative options including:

  • Family-based sponsorship as immediate relatives of US citizens.

  • U-Visa/VAWA: Certain victims of qualifying crimes and domestic violence could qualify for a visa. 

  • H-1B Non-Immigrant Worker Visas or TN visas.

  • Employment-based sponsorship.

What You Can Do Now

Research your immigration history and look for an experienced immigration attorney to discuss any available immigration options. Lastly, continue to renew any DACA requests 150 days prior to the current expiration date listed on your current card.
