USCIS Publishes Update on Policy Manual (PM)

On May 22, 2024, the United States Citizenship and Immigration Services (USCIS) updated their Policy Manual with regards to family-based immigrant visa petitions including Form I-130 and Form I-360.

Summary of Policy Manual Updates:  

  • Explanation on how USCIS handles errors on family-based approval notices

  • How petitioners may contact USCIS to correct errors or update a Form I-130

  • Clarification on where approval notices are sent subsequent an approval

  • Explanation of how USCIS decides to approve or deny family-based petitions

USCIS reminds all Form I-130 petitioners to clearly indicate the beneficiary’s current address. Petitioners should also specify whether the beneficiary will seek to adjust status (if eligible) or seek consular processing abroad.

Failure to clearly indicate consular processing or adjustment of status on the form may lead to unnecessary delays in processing or additional forms and fees. Where there is no clear indication on a Form I-130, USCIS will exercise discretion in deciding whether to send a case for consular processing based on beneficiary’s most recent address or location.
