Using FOIA Requests to Locate Immigration Records

Ever wondered how you can locate your immigration record? In the United States, individuals can request their own immigration records under the Freedom of Information Act (FOIA) and Privacy Act.

What types of immigration records can I request? You can request all sorts of immigration records for yourself or someone else with their written consent, including, but not limited to:

  • Approvals from USCIS

  • Notices from USCIS including receipt notices, Notice of Intent to Deny or Revoke, and Denial Notices

  • CBP encounters and apprehensions

  • Copies of submitted Form I-90

  • Copy of Naturalization Certificate

  • Labor Certification issued by US Department of Labor

  • Copy of submitted Form I-485

Why is obtaining your immigration important?

Having a more complete immigration record is an important tool for your attorney when providing guidance and advice about your immigration options including 245(i) eligibility and other proof of lawful entries into the US.

Where can I make a FOIA request?

FOIA requests can be submitted to various governmental agencies including the United States Citizenship and Immigration Service (USCIS), US Customs and Border Protection (CBP), the Department of State (DOS), among others.
